Applicant seeks two findings and a special permit relative to proposed structure expansion on a nonconforming lot.  Property is located at 23 Condor Rd. and is situated in the Single Residence A Zone within the Groundwater Protection District.

Conservation Commission letter dated 9/27/05 read.  Stating no objections.

 

Applicant described the plans to add family room (great room) and deck on the first floor and on the second floor a walk-in closet off the master bedroom.  The family room will open into the kitchen and the new deck will be off the family room

 

The Board requests a new plot plan needed to show the set backs.

Applicant presented the Board with revised plans dated 9/19/05 showing a 5 ft opening in the wall between the bedroom and the office.

 

The Applicant has not provided the Board with an approved septic system from the Board of Health.

 

Existing living space is 2104 and proposed living space is 343.

Vote will be taken on October 26 as long as the Board has an approved septic system plan from the Board of Health.

#1532              Senior Operations, Inc.                                  1125 Providence Hwy.

Applicant seeks special permit to extend or alter prior nonconforming condition under MGLA CH 40Sec 6 and Sharon Zoning Bylaws Sec 6412b.  Property is located at  1075 Providence Hwy. and is situated in the Light Industrial Zone within the Groundwater Protection District.

Len Simons made reference to a letter from Margaret Walker, P.E., Town Engineer of Walpole.  Stating that in the opinion of that department that the drainage system BMP upgrades as shown on the plan and as proposed can be seen as a benefit to the site, and a vast improvement to the protection of the adjacent wetland and aquifer.

 

It was stated that Lot B has always been considered a separate parcel.

 

Mr. Simons stated that Greg Meister approved the conservation restriction plans provided by Sr. Operations.  Also, that Lot A will have an easement to the Conservation area.

 

The Board requested a letter from Greg Meister stating that he has indeed approved the conservation restriction.

 

The Board reviewed the draft decision and changes will be made in the Findings and Exhibits. 

 

Mr. Simons presented the Board with a document stating a proposed condition on special permit approval relative to future uses of sites located within the Town of Sharon’s Water Resources Protection District and the site that is approximately 1700 linear feet from Walpole Town Wells number 6 and 8 which are maintained by the Town Of Walpole as part of that Town’s public water system.

#1496              Herb Chambers of Sharon, LLC                   55 Gen. Edwards Hwy.

Applicant seeks variances, a special permit pursuant to section 2334(g) and site plan approval under Section 6321 relative to site conditions at 15 and 55 General Edwards Hwy. and 845 Old Post Road.  Property is located at 55 General Edwards Hwy., 15 General Edwards Hwy., 845 Old Post Road and 000 Field Street and is situated in the Light Industrial Zone District.

 

Joel Fishman came before the Board requesting a 6 month extension for exercise of the rights authorized by the variance.

 

After reviewing documents provided by Attorney Fishman.

 

The Board granted a 6 month extension.

#1534              Massapoag Realty Trust                              Lot 32 Michael Ln.

Applicant requests the Board of Appeals to overturn a decision of the Building Inspector regarding the definition of “Lot Area”  in Article 5 of the Zoning By-Law.  Property is located at Lot 32 Michael Ln. and is situated in the Single Residence A  Zone.

 

 Hearing opened at 9:40 p.m.

 

Attorney Mangiaratti gave a brief review of documents and the fact that the Planning Board approved the plans on 10/4/78.

 

The Board still has concern with the 90% high and dry lot area requirements.

 

The Board has decided to speak with Town Council in regards to this matter.
